  • I recognize the artwork because I've seen it used in the NME with Morrissey on the cover. It was an April issue, if I remember correctly.

    I have created a version similiar to that artwork for my own enjoyment. I however did it with the understanding that technically, the artwork does not belong to me or anyone else to use, even if it is to raise money for the worthiest of causes, such as yours.

    I'm not sure if the NME will raise a stink, depending on the quantity sold but, you never know. Maybe it will even prompt them to make a commercial version of their own with all parties compensated for.

  • Everyone's jokes aside, I think this is a serious issue. April, I'm sure you're a nice person and I looked at your sites and everything, but the fact is that the previous posters who mentioned that you could be digging a really serious hole for yourself are right. Selling copyrighted images as your own is infringement, no matter what the profits, how big or small, or what they're used for. The fact that you seem to do this with Elvis images, various Sanrio characters, and quite a few different Morrissey ones as well rather leaves a bad taste in the mouth. I think every college kid and Moz fan could try funding their travels and tickets by selling copyright images as their own, but people don't do this because those images are simply not for anyone to take and use as they please.

    And before anyone thinks I'm full of misery and on my soapbox for no reason, just want to mention that I've seen teenage girls get arrested outside concerts for selling stickers of copyrighted pics, I've seen Graceland sue one single lone guy that was selling Elvis plates on the internet, and we all know about the Morrissey fan who got sued a few years ago for similarly trying to sell Morrissey t-shirts at a Smiths convention using old pictures that were someone else's property (ie also copyrighted material).

    Just thought maybe you should know. I think the getting a part time job option is safer, more honest, and what everyone else has to resort to anyway. Just my thoughts.

  • so, i'm against this for so many reasons i can't begin to explain. interestingly enough, i'm checkin' out aprils website and notice there is no image/lyric that this woman won't steal to make a buck off of. check out the button page! then, and this is just fucking wonderful, i go to her hubbys site and check out some of his stuff. he has this website called other peoples photos or something like that and at the bottom of the page it reads:

      "these photos were found in various places and collected by david hornbuckle.
    while i don't claim copyright, please don't use them elsewhere without permission or a link back here. thanks."

    so at least her husband understands the concept of not using someone elses image for profit without permission!

    i don't believe this girl is trying to raise money for anything other than simply raising money! cashing in on morrisseys recent ressurgence.

    lets see - if she wants to risk infrngement of copywrite - its her perogative - if she wants to create images that are based on other peoples work - let her chance her arm - she could always say she is part of a long history of artistic expression through appropriation, after all, Warhol didn't design the soup tin - but she might have trouble convincing the court - its really up to her - she's a grow adult - so are we, if we don't like them - don't buy them - or alternativly, scan the original and get your own t-shirt printed from an iron on kit you get from the stationers using a simple home printer.

    As for a couple of the other comments - as offensive as some people find them - I can state as a point of absolute fact - based on 15 years of working in the media - sex sells, and wet t-shirts sell better than dry ones - after all, 'Some Girls are bigger...." ( can't believe I'm the first person to say that, you lot are really slipping )
